General Terms and Conditions (GTC) for End Customers (B2C) – Travelmania Germany
These General Terms and Conditions supplement the statutory provisions of Sections 651a–y of the German Civil Code (BGB) and, insofar as they have been effectively agreed, form an integral part of the package travel contract.
1. Conclusion of the package travel contract
1.1 By registering for the trip, the customer makes a binding offer to Travelmania Germany (hereinafter: Travelmania) to conclude a package travel contract. Registration is usually done electronically by email. The contract is concluded upon acceptance by Travelmania. Acceptance does not require any specific form. Upon or immediately after conclusion of the contract, the customer will receive a travel confirmation on a durable medium.
1.2 If the content of the travel confirmation differs from the content of the registration, this constitutes a new offer from Travelmania, to which Travelmania is bound for a period of 10 days. The contract is concluded on the basis of this new offer if the customer expressly declares acceptance within the binding period or pays a deposit or the travel price.
1.3 The customer is liable for all contractual obligations of fellow travelers for whom she makes the booking, as for her own, provided that she has assumed this obligation by means of an express and separate declaration.
1.4 Please note that, due to the legal provision of § 312 g para. 2 sentence 1 no. 9 BGB (German Civil Code), there is no right of withdrawal for package travel contracts concluded by means of distance selling after the contract has been concluded for all of the above types of booking. However, withdrawal from and termination of the contract is possible in accordance with the provisions of clause 6.
2. Service description
Travelmania Germany offers small group tours (max. 12 participants) and individually tailored travel plans within Germany. Services generally include hotel bookings, transfers, transportation, and a culturally rich program. Flights are not included in the offer. 3. Booking process and minimum number of participants
Bookings are made using an online registration form. For small group tours, a minimum of 6 participants is required. If this number is not reached, Travelmania may withdraw from the travel contract in accordance with the following provisions:
The minimum number of participants is specified in the travel advertisement, as is the date by which the traveler must receive notification at the latest before the contractually agreed start of the trip. The booking confirmation specifies the minimum number of participants and the latest cancellation deadline. Travelmania is obliged to immediately notify the traveler or the group organizer, as the traveler’s representative, of the cancellation of the trip if it is certain that the trip will not take place because the minimum number of participants has not been reached. If it becomes apparent at an earlier stage that the minimum number of participants cannot be reached, the tour operator must immediately exercise its right of withdrawal. If the trip is not carried out for this reason, Travelmania must refund the customer’s payments for the trip immediately, but in any case within 14 days of receiving the cancellation notice.
4. Payment
4.1 Payments for the travel price prior to the end of the trip may only be requested or accepted if Travelmania has a customer money protection agreement and the customer has been provided with a security certificate in accordance with Section 651r (4) of the German Civil Code (BGB).
4.2 After conclusion of the contract and handover of the security certificate, a deposit of 20% of the travel price is due, unless otherwise agreed. The remaining amount must be paid no later than 30 days before the start of the trip. Payments can be made by bank transfer, PayPal, or credit card.
4.3 If the customer defaults on the down payment or final payment, Travelmania shall be entitled, after issuing a reminder with a deadline for payment and a warning of withdrawal, to withdraw from the contract and demand compensation in the amount of the agreed lump-sum compensation (see section 6.2).
5. Changes to services and prices
5.1 Changes to individual travel services from the agreed content of the package travel contract that become necessary after conclusion of the contract and were not brought about by Travelmania in bad faith are only permitted if they are not significant and do not affect the overall nature of the booked trip.
5.2 Travelmania shall inform the customer of any changes immediately on a durable medium. In the event of significant changes to the contract or a price increase of more than 8%, the customer may withdraw from the contract free of charge or request participation in a replacement trip.
5.3 Price adjustments after conclusion of the contract are only permissible if there are demonstrable and unforeseeable changes in transport costs, taxes, or exchange rates. In the event of an increase related to the seat, Travelmania may demand the amount of the increase from the traveler. In other cases, the additional transportation costs charged by the transportation company per means of transportation are divided by the number of seats in the agreed means of transportation. Travelmania may charge the traveler for the resulting increase in cost per seat. If the fees payable to the tour operator at the time of conclusion of the travel contract are increased, the travel price may be increased by the corresponding proportionate amount. In this case, Travelmania must inform the traveler of the price increase and the reasons for it, as well as the calculation of the price increase, in a clear and prominent manner on a durable medium immediately after becoming aware of the reason for the increase. The notified price change shall be deemed accepted if the traveler does not respond or does not respond within the period set by Travelmania. Travelmania undertakes to pass on travel price reductions resulting from the aforementioned costs to the traveler in accordance with § 651 f (4) BGB (German Civil Code) at the traveler’s request. The traveler may demand such a price reduction in particular if and to the extent that the above-mentioned costs, which may also lead to a price increase, have changed after conclusion of the contract and before the start of the trip and this has led to lower costs for Travelmania. In this case, Travelmania is entitled to deduct the administrative expenses actually incurred from the excess amount to be refunded. Travelmania shall provide evidence of the amount of administrative expenses incurred. If the exchange rate applicable at the time of conclusion of the contract for the travel services underlying this trip changes and this results in the trip becoming more expensive for Travelmania, the travel price may be increased for each travel participant to the extent that the price increases affect the proportion of the booked capacity. In the event of a subsequent increase in the travel price, the organizer must inform the traveler immediately. Price increases from the 21st day before departure are invalid. In the event of price increases of more than 8%, the traveler is entitled to withdraw from the travel contract at no cost or to demand participation in a trip of at least equal value if Travelmania is able to offer such a trip from its range without additional cost to the traveler. In the first case, Travelmania will immediately refund the payments made to it. The mutual rights and obligations referred to in this paragraph shall also apply in the event of a permissible change to an essential travel service. The traveler must assert these rights immediately after Travelmania has announced the price increase or change to the travel service. The notified price change shall be deemed accepted if the traveler does not respond or does not respond within the period set by Travelmania.
6. Cancellation by the customer, replacement participant, and insurance companies
6.1 The customer may withdraw from the contract at any time prior to commencement of the trip. The date of receipt of the notice of withdrawal by Travelmania shall be decisive. The withdrawal should be made in writing.
6.2 In the event of withdrawal, the following flat-rate compensation shall apply unless otherwise agree:
- Up to 60 days before departure: 25%
- 59 to 30 days before departure: 45%
- 29 to 15 days before departure: 65%
- 14 to 7 days before departure: 85%
- 6 days or less before departure or in case of no-show: 95%
For individually booked tickets or services that cannot be rebooked, the respective cancellation conditions of the service providers apply, insofar as these were agreed upon in connection with the conclusion of the contract.
6.3 If the customer can provide a replacement participant, the latter shall assume the rights and obligations of the contract (§ 651e BGB). Travelmania may object to the replacement if the replacement participant does not meet the specific travel requirements or if there are legal restrictions. The customer and the replacement participant shall be jointly and severally liable for the travel price and any additional costs incurred.
6.4 In the event of unavoidable, exceptional circumstances at the destination, the customer may withdraw from the contract free of charge (§ 651h III BGB).
6.5 Travelmania expressly recommends taking out travel cancellation insurance and insurance to cover repatriation costs in the event of accident, illness, or death.
7. Cancellation by Travelmania (minimum number of participants)
7.1 Travelmania may withdraw from the contract up to 28 days before departure if the advertised minimum number of participants (usually 6 persons) is not reached, provided that this number was specified in the travel advertisement and confirmation. In the event of withdrawal, all payments made will be refunded immediately.
7.2 Travelmania may withdraw from the contract in the event of unavoidable, exceptional circumstances (§ 651h IV No. 2 BGB).
8. Special notes
8.1 Suitability of the trip for persons with limited mobility
The trips offered by Travelmania are generally geared toward small groups and individually planned programs. They are only suitable to a limited extent for persons with limited mobility. Information on the general suitability of the respective trip for persons with limited mobility can be found in the respective trip description or obtained from us upon request.
Please let us know when booking if you have limited mobility or require special assistance. We will be happy to check on an individual basis whether and to what extent participation in the desired trip is possible and what assistance can be organized if necessary. Special requests, special requirements, or the transport of medical equipment are only considered agreed upon once they have been expressly confirmed in writing by Travelmania.
If an accompanying person is required to participate in the trip, this must be organized and booked by the customer herself.
8.2 Passport, visa, and health requirements
Travelmania undertakes to inform travelers about the general provisions of passport, visa, and health regulations of the destination country, including the deadlines for obtaining any necessary visas before the contract is concluded, as well as about any changes to these regulations before the start of the trip.
Travelmania is not liable for the timely issuance and receipt of necessary visas by the respective diplomatic mission if it has been commissioned to obtain them, unless Travelmania is responsible for the delay. The traveler is responsible for obtaining and carrying the necessary travel documents and complying with all regulations important for the execution of the trip.
All disadvantages, in particular the payment of cancellation fees resulting from non-compliance with these regulations, shall be borne by them, unless they are caused by culpable misinformation or non-information on the part of Travelmania.
It is strongly recommended that you take out travel cancellation insurance and insurance to cover repatriation costs in the event of accident, illness, or death.
9. Warranty and liability
9.1 If travel services are not provided in accordance with the contract, the customer may demand remedial action. The defect must be reported immediately to the local tour guide, the contact person, or Travelmania.
9.2 Travelmania shall be liable within the scope of the statutory provisions for the proper provision of the contractually agreed travel services. Travelmania’s contractual liability for damages that are not physical injuries and were not caused culpably shall be limited to three times the travel price. Any claims beyond this under international agreements or legal provisions based on such agreements remain unaffected by this limitation.
Travelmania is not liable for services expressly designated as third-party services (e.g., additional museum tours, restaurant visits, etc.). The statutory provisions (§ 651h BGB) apply to service disruptions due to force majeure.
10. Contact and emergency management
A 24/7 emergency number and a personal contact person are available during the trip. For small group trips, an experienced tour guide accompanies the group on site.
11. Data protection
Personal data will be processed exclusively for the purpose of executing the travel contract. The privacy policy of Travelmania Germany applies.
